The “I Don’t Need a Lawyer” Myths

Over the years, I have talked to a lot of people who have been involved in car crashes, many of whom told me they believed they did not need a lawyer. Though their reasons varied, I found that they were almost always wrong. I’d like to address some of the misconceptions about insurance companies people commonly believe and the reasons why YOU NEED A LAWYER.
MYTH #1: I have full coverage insurance, so I don’t need a lawyer to help me with my claim.

REALITY: All policies have their limits and restrictions. Just because you have bodily injury coverage as well as liability coverage does not mean that the insurance company will deal with you fairly. The insurance companies evaluate your injuries based on their own criteria and almost always undervalue them. Having additional policy coverage does not change the way your insurance company evaluates your claim. Also, if the other driver in the crash is at fault, that driver’s insurance company’s job is to side with their insured. They will find any reason possible to attribute fault to you or to claim your injuries are not related to the crash.

MYTH #2: I will find out what the insurance company has to say first, then I will consider hiring a lawyer.

REALITY: If you deal with the insurance company on your own first, you may damage your claim. This is because the insurance company will ask you to give them a recorded statement prior to negotiating settlement on your claim. Adjusters sometimes ask questions in such a way that will twist your answers to make them seem like you said something else. Once they have gotten you to make statements in a certain way they can use these statements against you when evaluating your claim and put less money on the claim than they should.

MYTH #3: The insurance company will be fair with me and will look out for my best interest.

REALITY: Insurance companies are in the business of making money–they are not there to be on your side. Adjusters are actually given a script and training to keep you from filing a lawsuit against them. Adjusters are also trained to get you to settle your claim quickly. They do this so you might settle your claim before you fully know what your injuries are. If you settle your claim or cash a check from your insurance company, you will not get a second chance to make a claim if you later discover more injuries.

MYTH #4: People who file claims or lawsuits are greedy.

REALITY: Over the years we have been given the impression that people who file claims or lawsuits as a result of their injuries are greedy. This is simply not true. The fact is that if you have been injured by someone’s negligence and you have a RIGHT to compensation. This is not being greedy; it is being made whole again. That is, in fact, the purpose of our court system. You should not have to lose money paying for medical bills, income, or enjoyment of your life because someone else was negligent.

It’s natural to want to believe that your insurance company will be on your side and will look out for your best interests after a car crash. But don’t be fooled—you NEED A LAWYER. Dealing with the aftermath of a crash can be difficult and overwhelming. You don’t have to do it alone, and we don’t want you to.
